U.S. Senate Candidate George Maragos, Jan. 18, 2012: Gillibrand is co-sponsoring legislation that will allow censorship of Internet content without legal due process. This is fundamentally against our constitutionally protected right of freedom of speech and due process. That Gillibrand would even contemplate such a Bill is both morally repugnant and un-American.

 

The Protect Intellectual Property Act (PIPA) proposed and co-sponsored by Gillibrand would give the Washington bureaucrats and corporations the ability to censor and shut down any web site simply by convincing a judge that the web site is “dedicated” to copyright infringement. Due process as guaranteed by the Constitution is not required. The web site will have no right to challenge the allegation of piracy before it is shut down and irrevocably damaged. This is simply outrageous and un-American and should not pass.

 

This legislation is extremely dangerous and can set us down a road of greater government control, censorship and denial of our constitutional rights. What will stop the government of extending this law beyond the Internet to our fundamental rights of free speech and due process?

 

Beyond its infringement of our rights, this bill will suppress innovation, kill thousands of jobs in New York City, the Hudson Valley, Syracuse, Rochester, Ithaca and technology centers throughout New York State. What is Gillibrand thinking of? Who is she working for? Not New Yorkers.

 

This job killing legislation co-sponsored by Gillibrand follows a series of previous votes that have destroyed hundreds of thousands of jobs and are costing middle class families and small businesses thousands of dollars. Examples include ObamaCare and the Dobb-Franks bills. Dobb-Franks destroyed nearly 200,000 high paying jobs in the financial industry in 2011 alone, according to the New York Times.

The job-killing Gillibrand legislation called the “Protect IP Act” (PIPA) would fundamentally change the make-up of the Internet and give government bureaucrats the authority to block public access to thousands of websites — the way China, Iran, and North Korea do. Ms. Gillibrand’s bill – which even she is now opposing – is being loudly panned by the founders and employees of Google, Yahoo!, Twitter, PayPal, Firefox, Ebay, Craig’s List, Wikipedia, The Huffington Post, and Netscape, among others.

Hollywood entertainment bigwigs were the bill’s major proponents. 

“There are only three possible explanations for Senator Gillibrand’s sponsorship of this anti-New York legislation,” New York State Republican Chairman Ed Cox said. “One: Ms. Gillibrand didn’t read the legislation before co-sponsoring it. Two: She read the bill and didn’t understand it. Or three: She understood the bill, but decided to support Hollywood’s interests over the interests of her own state.” (Senator Gillibrand has received more than $610,000 from the Hollywood/entertainment industry in the past year.) 

Chairman Cox posed three questions to Senator Gillibrand, which he says she must answer in the interest of government transparency – something the Senator has repeatedly called for herself: 

1. Did you read the PIPA legislation before sponsoring it? 

2. If you read it, why did you sponsor it when it was clearly damaging to NY?

3. Did you discuss the legislation with any contributors before sponsoring it?

“New York State is ranked the worst state in America for business growth, and misguided bills like this one show exactly how we’ve gotten into this mess,” Chairman Cox continued. “It would be instructive for all of us to learn the thinking behind Ms. Gillibrand’s sponsorship of this debacle.”

Albany, NY-Jan. 18…New York’s junior senator, Kirsten Gillibrand (D-WFP), in perhaps the biggest flip-flop yet in a political career marred by flip-flops, is running away from a bill she co-sponsored that could have all but destroyed New York’s Internet job base, the New York Republican State Committee today noted. The committee is asking Senator Gillibrand today whether she read the job-killing legislation before sponsoring it.

Ms. Gillibrand has famously changed positions on gun laws – she used to say she packed heat under her bed, but she can’t quite find it now – on fiscal policy, taxes, gay marriage, immigration, tobacco, etc., etc.

“Senator Gillibrand was fighting to pass a bill yesterday that could have decimated Internet-based job growth in New York State, but today she wants nothing to do with it,” said New York State Republican Chairman Ed Cox. “Her PIPA legislation would have done to New York’s information industry what her Obamacare legislation is about to do to the healthcare industry – gutting it with government regulation. What we need to know is whether Senator Gillibrand actually read this legislation before sponsoring it. How could she back a bill this obviously destructive to New York’s economy?”

Ed Cox Criticizes Kirsten Gillibrand for Fundraising Abroad

In a release entitled “GENEVA’S ZIP CODE IS: 14456 Not CH-1201,” New York State Republican Party Chairman Ed Cox took issue with Senator Kirsten Gillibrand for raising money from Americans in Europe. Senator Gillibrand is indeed in Geneva, Switzerland today as part of a fundraising tour that is also taking her through Paris and London.

“People in Geneva, Switzerland may have more money than people in Geneva, NY, but that’s no excuse to be running around the globe on a fundraising junket while there is work to be done here at home,” Chairman Cox said.  

Mr. Cox goes proceeds to attack Senator Gillibrand’s for continuing to support health care reform, “while sipping champagne, popping canapés, and filling her campaign coffers in the shadow of the Swiss Alps.” And, although the Senate has not convened for 2012 yet, Mr. Cox says that the Senator should be working to create jobs right now instead. “She’s clinking glasses overseas when she should be cracking heads in Washington to actually get a bill passed.”

New York Republicans are hoping to defeat Senator Gillibrand, who’s up for election again in 2012. The Republican candidates who are most aggressively campaigning for the seat at the moment include The Ladders.com founder Marc Cenedella and Nassau County Comptroller George Maragos. Mr. Maragos recently announced that he’s placed $1 million dollars into his  own campaign.

Senator Gillibrand is herself a prodigious fundraiser and is likely to add to the already substantial $7 million she last reported having on hand for her campaign when financial reports are due in the next couple weeks.

Look at the donation form used at this big dollar Silicon Valley “California” fundraiser for the “New York” Senator below. It contains the proper disclosure ”Contributions from foreign nationals are prohibited”, does she think US Law doesn’t apply when actually fundraising in the lands of  foreign nationals? The concerns shared by Mr Cox above are one thing and we share in those sentiments. However, we don’t believe for one minute that while fundraising in a foreign city 100% of the monies involved is coming from Americans, and therefore we’re taking this a step further and calling it an outright scandal. If $1, whether as an in kind donation, or outright cash, is Swiss, then Gillibrand  should be investigated for illegal campaign finance activity, and  fined, sanctioned, censured, impeached, whatever is appropriate!

• Tech Groups Host Valley Fundraisers for Dem Senators

Two organizations representing the technology industry are organizing and hosting fundraisers for Democratic senators this week in Silicon Valley, according to emails obtained by the Alley.

TechAmerica is helping what the trade association calls “tech-friendly” Democratic senators pull in thousands at events in Atherton and Palo Alto, Calif. There was a reception last night for Sen. Kirsten Gillibrand of New York, and there is one on Wednesday for Sen. Jeff Merkley of Oregon and Sen. Mark Warner of Virginia. There is also a lunch Thursday for Sen. Christopher Coons of Delaware.

Another tech trade group, TechNet, is organizing a fundraising brunch for Sen. Tom Carper (D-Del.) on Thursday. It is also hosting the Democratic Senatorial Campaign Committee National Innovation Conference on Thursday and Friday. Democratic senators scheduled to attend are Carper, Mark Begich, Merkley, Coons and Patty Murray, the co-chair of the Super Committee. (and by the way, weren’t these Super Committee folks supposed to be forgoing fundraising while holding that post as a matter of ethics and avoiding conflicts of interest?)

 

Republican State Chairman Ed Cox met this morning with county party leaders at the Fort Orange Club, and his message was simple: 2012 will be a good year, and we will take out Sen. Kirsten Gillibrand.

“Needless to say, one of our highest priorities will be to increase our majority in the State Senate, and elect more Republicans to the Assembly,” he said, according to a draft version of his remarks sent by a source.  “We also believe that Senator Gillibrand is vulnerable, and there are at least two highly qualified Republicans interested in challenging her.”

He went on to accuse her of flipping her position on several issues. I’ve written about GOP candidates lining up against our freshman representative, but not gaining much real traction. George Maragos is most active on the circuit, and other potential candidates include Harry Wilson (who doesn’t seem likely to run), Dan Rubino and Marc Cenedella.

Cox said the state party will hold its annual dinner in Manhattan “just prior” to the April 24th presidential primary. The party convention will be held in Rochester — when the political calendar is set.

House Subcommittee Examines Administration’s Efforts to Undermine Secure Communities

On Wednesday, the House Subcommittee on Immigration Policy and Enforcement held a hearing on the Obama Administration’s efforts to undermine the Secure Communities program. Through the program, local law enforcement officers submit the digital fingerprints of all individuals they book for comparison against the Department of Homeland Security (DHS) and Federal Bureau of Investigation’s (FBI) databases to determine if the person is an alien. If the DHS database identifies the individual as an alien, that information is sent back to both the local jail/prison and the local ICE office for further action. In most circumstances, ICE would issue a detainer on the alien and begin deportation proceedings.

Communists and Terrorists.

Take your eyes off the distraction of Occupy Wall Street. Because the radical left is busy launching a stealth attack to seize control of every town and county in America. Recently you heard NYLR sound the alarms on New York’s version of Agenda 21. And for good reason because Agenda 21 is the tipping point.

Previously the Green Movement has consisted of a small group of people who actually believed they were doing good in an effort to save the world, consisting of the environment and wildlife. These people, environmental activists and elected officials, were generally well-meaning and relatively harmless.

Nevertheless, these do-gooders or Green Movement have been posing a major threat to our economy. Nationally, excessive and needless regulations have become a burden in our ability to access and use our own natural resources. It is unequivocally responsible for the rise in energy prices, which has a chain reaction and is leading to inflation in energy and food prices.

On Long Island, excessive regulations, overzealous oversight by the DEC, county Health and Planning Depts, Town and Village zoning, planning, permitting, forced studies, and various green civic groups have broken the back of property owners, developers, job creators, and their constitutional rights.

Additionally, during the past 20 years over $3-1/2 billion has been taken from the Long Island taxpayer for the purpose of land preservation. This set off another chain reaction that led to skyrocketing housing prices and taxes; and a mass industry, jobs, and human exodus off Long Island.

As if all that wasn’t dangerous enough, our elected leaders have been either clueless or misguided as to the true nature of the current Green Movement.

Towns and counties all across America are under siege from programs that have been presented as nonpartisan environmentalism – but this is not accurate. This Green Movement is now advancing a partisan agenda that mirrors Green Party goals and communism. And the primary strategy is to achieve a level of dictatorial control over the American people. Agenda 21 is progressing rapidly across America and now New York too.

Where is NYLR going with all this?

A few days ago, former White House green jobs czar and professed communist Van Jones offered a prediction for those who have been watching the Occupy Wall Street movement. He said, “You haven’t seen anything yet.” In an interview with CNN, he said that the movement is ready to evolve into the areas of politics and policy-making.

Hmmm…

Van Jones. Him again? Why now?

We all remember Van Jones? Officially, before having to resign, he was Obama’s Green Jobs Czar. He was responsible for creating “green jobs” to combat climate change. Clueless Republicans need to be reminded that Van Jones is also a convicted felon, a self-proclaimed communist and a committed Marxist-Leninist-Maoist.

In 1992 Jones was arrested during the Rodney King riots. While in jail he converted from a black nationalism to radical communism. He loathes capitalism because he claims it exploits nonwhite minorities worldwide. He also views police officers as the arch enemies of black people.

But again, why is Van Jones back in the news?

Is it a coincidence that at the same time the Green Czar Communist Van Jones is back, main stream media is in a New York environmental frenzy?

Well one of the big advisors to the New York Climate Action Council is a group called the Apollo Aliance.

The New York Apollo Alliance founder was Jeff Jones.

Before Jeff Jones was scrubbed from the Apollo’s website, it stated;

Jeff Jones campaigned to remove PCBs from the Hudson River, clean up toxic pollution in inner-city and rural neighborhoods and reverse global warming. From 1995-2005, he was the Communications Director of Environmental Advocates of New York. Previously, he was a reporter covering state politics and policy for a variety of news organizations.

Mr. Jones has devoted much of his time to researching and confronting federal and state energy policies that contribute to global warming and catastrophic climate change. In 2006, he represented the state Apollo Alliance on the governor’s Energy and Environmental Transition Task Force. He serves on the boards of directors of several organizations, including the Healthy Schools Network, the Mohawk Hudson Land Conservancy and West Harlem Environmental Action (WeAct for Environmental Justice).

And what does Jeff Jones have to do with the Green Czar Communist Van Jones?

Jeff Jones is a former member of the 1970s terrorist organization, the Weather Underground.

More than that Jones was a founder and one of four key leaders of the organization with Mark Rudd, Bill Ayers and Bernardine Dohrn. Remember those names. All Communists and terrorists.

Is all this a coincidence?

All this news is out there folks. This article is not some incredible piece of investigative journalism.

The point is that the Green Movement, the do-gooders that were just economic killers, have now been hijacked by a national and global array of communists hell bent on overthrowing the United States of America. And New York has become another battleground.

And, worse, how can someone who violently acted in opposition to the government of the United States be a part of advising New York on environmental issues? Is he a scientist? An expert? Or is he an activist whose ideology is at complete odds with the Constitution of the United States.

To which activist do I refer? Jeffrey Carl Jones.

In 1974 Jones co-authored — along with Bill Ayers, Bernardine Dohrn, and Celia Sojourn – the book Prairie Fire: The Politics of Revolutionary Anti-Imperialism, whose title was an allusion to Mao Zedong‘s observation that “a single spark can start a prairie fire.” This publication contained the following statements:

• “We are a guerrilla organization. We are communist women and men … deeply affected by the historic events of our time in the struggle against U.S. imperialism.”

YET, “In 2006, he [Jeff Jones] represented the state Apollo Alliance on the governor’s Energy and Environmental Transition Task Force.”

Jones justifies his activities thus, “and by a criminal war waged by my government against the people of Vietnam. So, as a teenager and young adult, I dedicated myself to supporting civil rights and opposing racism, and to ending the illegal and genocidal Vietnam War.”

This is the communist view of the Vietnam War. Who was genocidal? The United States? The following excerpt is by Jean-Louis Margolin in The Black Book of Communism (pgs. 566-569), who also states, “Communism was never incompatible with nationalism or even xenophobia, particularly in Asia.” On the history of the Communist Party in Vietnam (which began around 1930):

One of the Party’s leaders proposed an assassination campaign to “speed up the advance of the movement.” Landowners and local mandarin were targets of choice, and popular tribunals were established to sentence them and confiscate their goods. The terror was also aimed at political opponents of the comparatively weak ICP which at the time had only 5,000 members. The Party wanted to produce a power vacuum as soon as possible so that it could assume leadersip of the nationalist movement. The Dai Viet, a nationalist party allied with the Japanese, was savagely persecuted, and the Viet Minh units under Son Tay asked Hanoi to send an electricity generator and a specialist so that they could torture “traitors” on a larger scale.

An article in the Viet Minh press in Hanoi on 29 August recommended that the people set up “traitor elimination committees” in every neighborhood and village. Dozens, perhaps hundreds, of Trotskyites were captured and killed. Others, who in October had helped defend Saigon against British and French forces, were deprived of munitions and food, and most were killed. On 25 August a state security organiztion was established in Saigon on the Soviet model and the prisons that had just been emptied began to fill again. The Viet Minh formed an Assault Assassination Committee, which marched through the streets. Most of its members were recruited from the local underworld, and it was at the head of the anti-French pogrom of 25 September that left dozens of mutilated corpses in its wake. Vietnamese women who had married Frenchmen were also systematically slaughtered, although these actions were blamed on people who were not really members of the Viet Minh In August and September alone the Viet Minh carried out thoushads of assassinations and tens of thousands of kidnappings

Agrarian reform began in 1953:

By eliminating potential centers of resistance to Communism, the land reform became an important stepping stone on the way to complete state control of the economy. And yet, even more so than in China, the traditional elite in the countryside maintained strong support for the Viet Minh becuse of the Party’s strongly nationalist stance. The Viet Minh’s ferocious and murderous methods were identical with those of their neighbors to the north. In every village, activists, occassionally enlisting the help of the theatrical troupes, tried to incite the poorer peasants (this was often extremely difficult) and encourage them to put their victims on public trial. the victims were chosen in a fairly arbitrary manner, frequently according to a quota of 4-5 percent, recalling again the sacred 5 percent of Maoism. These victims were often killed, or at the very least imprisoned, and their goods confiscated. As in China, the entire family was forced to suffer.

Pg. 569:

The exact number of losses is hard to gauge, but they were certainly catastrophic. There were propbably some 50,000 executions in the countryside (excluding combat deaths).

ClimAid Spotlight: NYSERDA’s Cynthia Rosenzweig, IPCC & Climategate 2.0

Cynthia Rosenzweig is not only the first author listed in NYSERDA’s ClimAid report (see here), she is the first listed on the leadership team and a member of the Climate Team. Dr. Rosenzweig’s degrees are in Soil and Plant studies. She is a Senior Research Scientist at NASA Goddard Institute for Space Studies (which emphasizes a broad study of global change, . . addressing natural and man-made changes in our environment)

She is a co-chair of the New York City Panel on Climate Change, a body of experts convened by the mayor to advise the city on adaptation for its critical infrastructure. She has co-led the Metropolitan East Coast Regional Assessment of the U.S. National Assessment of the Potential Consequences of Climate Variability and Change, sponsored by the U.S. Global Change Research Program. She was a Coordinating Lead Author of the IPCC Working Group II Fourth Assessment Report observed changes chapter, and served on the IPCC Task Group on Data and Scenarios for Impact and Climate Assessment.

It seems Dr. Rosenzweig was not only on the IPCC, she had a key role – several key roles. Donna Laframboise, No Frakking Consensus, points out that a few of the scientists on the IPCC “wear several hats.” Rosenzweig, wore six. “In other words, certain names pop up again and again in IPCC reports. If shadowy interests were trying to ‘control the message’ in these documents, entrusting key tasks to a small group of people might be an effective strategy.”

Cynthia Rosenzweig is one of the authors of “Millions at risk: defining critical climate threats and targets”

. . the identification of critical impacts (e.g. ones that should be avoided at any reasonable cost) is obviously a key to addressing targets for mitigating climate change. Indeed, a central objective of the UN Framework Objective on Climate Change (UNFCCC) is to avoid “dangerous levels” of climate change that could threaten food security, ecosystems and sustainable development (areas of risk that are specifically mentioned in UNFCCC Article 2).

For several years, we have been researching impacts in key areas of risk: hunger, water shortage, exposure to malaria transmission, and coastal flooding, as part of a global fast-track assessment (Parry and Livermore, 1999). 1 The results of our work have been reported widely and form a significant part of the IPCC’s assessment of likely impacts.

Also in Ms. Lafromboise’s article on IPPC Insiders,

“It [the Congressional testimony of Roger Piekle Sr] received no media attention, of course, but the written version of Pielke’s testimony contains a searing accusation that the public surely has the right to hear about. In his view:

The climate science assessments of the IPCC…are completed by a small subset of climate scientists… [bold added, p. 2]

At that same hearing John Christy, a professor of atmospheric science – who is a climate skeptic – voiced the identical concern. In his words:

The content of [IPCC] reports is actually under the control of a relatively small number of individuals – I often refer to them as the “climate establishment” – who through the years, in my opinion, came to act as gatekeepers of scientific opinion and information… [bold added, p. 17]

 What good is having someone in the US Senate leadership representing your state — if he’s going to work to hurt it?

Certainly Sen. Chuck Schumer’s new “millionaire’s tax” is not in New York’s best interests.

Schumer and Senate Majority Leader Harry Reid seek a 5.6 percent surcharge on earnings over $1 million to pay for yet another $450 billion stimulus plan.

Problem is, New York has a wildly disproportionate share of the nation’s seven-figure earners: Though home to less than 7 percent of the US population, the state collects income tax from some 15 percent of the $1 million-plus crowd, the Manhattan Institute estimates. So Schumer’s hike will sting far more here than elsewhere.

So what, you say? They can afford it?

Well, the hike would also hit income from capital gains, interest and dividends, slapping New Yorkers harder still — both personally, and by further weakening the economically critical financial sector.

Now, we understand why a junior senator like Kirsten Gillibrand rushed (as one blog put it) to “side with Schumer” on the tax. But New York’s senior senator should know better. If he won’t look out for the state’s interests in the Senate, who will?

Not that the hike will help other Americans, though. (Even the pro-tax New York Times noted yesterday that the plan “seems more about politics than policy.”)

President Obama has sought to stir up animosity toward “millionaires and billionaires” as he heads toward the presidential race, and he may be succeeding.

No one really believes another nearly half-trillion dollars in new spending, paid for with a nearly half-trillion-dollar tax hike, will help the economy one bit. (Even Keynesians say you need to increase deficits to boost GNP.)

Rather, by further taxing investments, small businesses and dividends, Schumer & Co. will only make the economy worse.

The good news for New York: The plan is expected to die. No thanks to Schumer.

Is Schumer Ignorant Of The Constitution

There is an interesting little editorial in the New York Post today about Senator Schumer’s support for the 5.6 percent surcharge on earnings over $1 million. The article makes a great point demonstrating how this particular tax impacts New York.

New York has a wildly disproportionate share of the nation’s seven-figure earners: Though home to less than 7 percent of the US population, the state collects income tax from some 15 percent of the $1 million-plus crowd, the Manhattan Institute estimates.

In Schumer’s defense he has stated the threshold should be higher.

Schumer said the $250,000 limit is unacceptable since it will hit the metropolitan area disproportionately because of the high cost of living here.

“$250,000 makes you really rich in Mississippi but it doesn’t make you rich at all in New York and there ought to be some kind of scale based on the cost of living on how much you pay,” Schumer said.

So in Chuckles mind there should be one set of taxes for rich New Yorkers and one for those rich folk in Mississippi. Unfortunately there is one little problem with this idea and it happens to be the Article 1 Section 8 of the U.S. Constitution.

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

It is a pretty sad day when member of Congress for 30 years and a Harvard Law School grad doesn’t know basic constitutional law.

Gov. Andrew M. Cuomo said on Wednesday that he was suspending New York’s participation in a federal immigration enforcement plan that has drawn fire from immigrant advocates, civil liberties lawyers and other elected officials in the state… The only other state to have pulled out of the program is, go figure, Illinois under the direction of fellow Democrat Gov Quinn, and the only other state currently considering pulling out of the program is Massachussetts, also under the direction of a Democrat Governor, Patrick Devall. (besides all 3 being Dem Gov’s/blue states, there is another tread here, they are all satellite states for ACORN groups and most significantly the SEIU who is notorious for not only coddling illegal immigration, but moreover for knowingly having illegals as dues paying members!)

Under the program, begun by the Bush administration in 2008, the fingerprints of everyone booked into a local or county jail are sent to the Department of Homeland Security and compared with prints in its files. If officials find that a suspect is in the country illegally, or is a noncitizen with a criminal record, they may seek to deport the person.

By Wednesday, that fingerprint sharing had been introduced in about 41 percent of the nation’s jurisdictions, including 27 of 62 counties in New York (with Chaut County and 7 others having just started utilizing the program last month, see below). Mr. Cuomo’s move means that those counties’ participation will end. The entire country is scheduled to join the program by 2013.

[one might note that NY has larger numbers of illegals within the state than others such as Arizona, and a higher cost too. Figures as of a couple years ago showed illegal immigration costing the tax payers of NY over $5 Billion annually and is projected to reach $10 Billion soon!]

PJ 09-20-2011 ELLICOTT POLICE

Lizardo Lopez was charged with two counts of endangering the welfare of

a child Sept. 10. Officers received a complaint from a mother of a young child
that he ex-boyfriend, Lopez, had physically abused her child. A warrant was issued for

Lopez and he was taken into custody the same day. According to police, Lopez

was found to be in the country illegally from Guatemala. The U.S. Border

Patrol was notified and an illegal immigration warrant was issued and served

once the charges in Ellicott were taken care of. He was taken to the Chautauqua

County jail on bail and is to be in Ellicott Town Court later.

PJ 06-23-11 – WESTFIELD POLICE

Julio Hernandez, 36, of Guatemala was turned over to the U.S. Border Patrol on

Monday. At 9:08 p.m. Westfield Police received a report of a suspicious person

attempting to buy alcohol at Crosbys in Westfield. According to police, it was

found that Hernandez was in the U.S. illegally.

Two more Illegals caught, turned over to Border Patrol

PJ 06-18-2011 WESTFIELD —

Armando J. Becerra, 37, Queretaro, Mexico, and Juan O. Ibarra, 27, Queretaro, Mexico, were turned over to border patrol for deportation after police checked on a suspicious vehicle parked at a local store. It was found they allegedly illegally entered the United States, made home in Mississippi and came to New York for work.

Three Face Illegal Immigration Charges Following City Stop

6-01-11 The Post-Journal

Three people were charged with being illegal immigrants Saturday.

Santos F. Segundo-Matias, 33, of Mexico; Jose L. Tapia-Sanchez, 32, of Mexico; and Jose Cruz-Lopez, 31, of Columbus, Ohio, and Mexico, were all charged at 1:29 a.m. Saturday with being in the United States illegally.

According to Jamestown Police, a vehicle was seen driving on East Second Street nears James Street, failing to keep right and crossing the fog line. The vehicle was pulled over on East Second Street near Niagara Street.

Three Hispanic men were found in the vehicle and all were allegedly found to be intoxicated. Multiple open and closed beer containers were allegedly found throughout the vehicle. The three men were reportedly staying at a hotel in Falconer and were in the area installing tile.

According to police, it was believed that the three men were in the country illegally. The U.S. Border Patrol was contacted and the three men were taken to the Jamestown City jail pending charges. The Border Patrol arrived at the city jail and found that the men were in fact illegal aliens.

No charges were pursued from the incident and the three men were released into the custody of the U.S. Border Patrol, of Erie, Pa.

ELLICOTT — Wilfredo Lopez, 24, of Sinclairville was charged with a federal felony of being an illegal immigrant on Sunday at 7:13 p.m. on Route 60 in Ellicott. He was released to a third party.

ELLERY — Hryhoriy Lakusta, 44, of Rolling Meadows, Ill., was charged with being an illegal alien Thursday at 1:07 p.m. Troopers took him into custody at the Ellery Overlook on Interstate 86 after finding out he was in the United States illegally. He was processed for the federal felony level charge and turned over the U.S. Border Patrol.

ELLERY — Valeriy Gomez, 46, of the Ukraine was charged with being in the country illegally on Tuesday. A trooper of the New York State Police Commercial Vehicle Enforcement Unit was performing an inspection on a tractor-trailer allegedly driven by Gomez at the Ellery Overlook on  Interstate 86 in Bemus Point. It was allegedly found that Gomez was undocumented and in the United States illegally from the Ukraine.  Gomez was taken into custody and turned over to the United States Border Patrol.

NORTH HARMONY

Ricardo Victoria-Escorza, 20, of Port Jefferson and Eusebio Trejo-Garcia, 23, of Austin, Texas, were pulled over in a vehicle for speeding on Interstate 86 in North Harmony. Both were found to allegedly be in the United States illegally. They were taken into custody and turned over to United States Border Patrol.

Ontario Man Steals Truck, Wrecks In Hanover

December 16, 2010 The Post-Journal

HANOVER – A Canada man was charged after allegedly stealing a truck in Canada, failing to stop at the U.S. Canadian border and then allegedly wrecking the truck in Hanover on Wednesday.

Mohammad Sabbagh, 22, of West Lakeshore Road, Mississauga, Ontario, Canada, was charged with third-degree burglary, second-degree criminal mischief and third-degree criminal possession of stolen property Wednesday at 12:30 a.m.

At 9:11 a.m., deputies responded to Hanford Road for a reported property damage accident. It was found that a 2011 Dodge pickup truck, which was found in a large drainage ditch, had hit a parked car in a business parking lot. The truck was found to have allegedly been stolen from a dealership in Mississauga, Ontario.

The vehicle was also found to have allegedly crossed the Peace Bridge Border with the U.S. and Canada, at a high rate of speed, failing to stop and endangering officers at the border. The vehicle had extensive front end damage. A search of the area turned up nothing at the time.

At 8:30 p.m., a concerned citizen reported a man acting suspicious in the area of the earlier incident. Deputies responded and allegedly found Sabbagh. He was allegedly found to have stolen the vehicle and was taken into custody.

He was charged in Hanover Town Court and taken to the Chautauqua County Jail without bail. Federal charges are pending concerning the incident at the Peace Bridge and the Peel Regional Police Service are in the process of placing charges against him for the incident in Mississauga.

The Chautauqua County Sheriff’s Office was assisted in the investigation by U.S. Immigration and Customs Enforcement, U.S. Customs and Border Protection and the Peel Regional Police Services, from Ontario.

We will be discussing the affordable housing settlement that was entered into with HUD by Westchester County during the Spano administration. Though my administration is ahead of schedule in constructing 750 affordable housing units, as per the agreement, the federal government is now looking to force the county to accept new demands that could bankrupt our county and force us to sue our local communities. It’s social engineering at its worst.

An Important Housing Settlement Update

Earlier this summer, I held an important press conference regarding Westchester’s Housing Settlement with the Federal government. HUD is trying to force me and Westchester County to dismantle local zoning, sue our municipalities and bankrupt our taxpayers. I will not allow that to happen.

We have been successful in working with our communities. In fact, we are ahead of schedule in terms of getting the housing built; far more than the settlement’s goal of 100 units by the end of the year. The Federal Monitor has approved 164 of the 750 units we are required to build. We have surpassed expectations because my administration is working with–not threatening–our local communities.

HUD, on the other hand, is making demands that have no basis in the law in general or the settlement in particular and that go way above anything any community in the United States has ever been asked to do.

We agreed to do what we agreed to do. Read the settlement for yourself. But we can only go so far. We cannot allow HUD to dismantle local zoning and bankrupt our taxpayers.

I encourage you to please take a moment to watch my press conference, read our press release and read the letter HUD sent to my administration. In the letter, HUD no longer refers to the agreement as a “housing settlement”. It is now an “integration order.” It is clear that HUD is using Westchester County as a test case for similar attempts to crush local government control nationwide.

My administration will continue to build upon the very real success we have had in actually building affordable housing, but we will not be intimidated by those who do not understand our communities, the laws that govern them and the New York State Constitution.

“We Will Never Forget” A day that will live in infamy indeed!

The face of evil- supported by an evil ideology- and an evil network- showed itself that day, and they may have struck us but they did not beat us. They took innocent lives, they maimed and injured and left scars, they knocked down our buildings, and they harmed our economy, but -

THEY DID NOT TAKE OUR FREEDOM, THEY CANNOT DIMINISH OUR LIBERTY, AND THEY WILL NEVER CRUSH OUR SPIRIT!

Over 3000 days now - since we lost over 3000 people – and no doubt we have shed over 3000 tears – said over 3000 prayers – and have stated our resolve over 3000 times in one way or another. On this 10th anniversary of that fateful day where we continue to face a monumental struggle of humankind, of good vs evil, let us remember all such things, and let us proclaim that this shall not be just a day of mourning and remembrance, but also a day of celebration in spite of those dark forces, and that those perished that day - and in the ensuing conflicts since - have not done so in vain. Yes, there is much to celebrate; the lives that were lived by those who perished, the survival of those who did not, the families and friends of survivors who have found strength from their loss and have done wonderful things for their communities through that strength, and the heroes – so many heroes - countless heroes. And yet there is one more thing to celebrate, as stated, our freedom; that they could not take away, that we continue to be a free people and a beacon of liberty for the world, and that though our lives may have been disrupted, they were not taken over, that we rightfully refuse to run for hills, and that we do not live in fear but rather with resolve and vigilance, that this thing shall be overcome, and goodness shall prevail.

May God justly bless each and every one of you, and may you please share in just a few of the 1000′s of tributes, memorials, and events being held -all in their own unique ways- from “sea to shining sea” this coming 9/11 weekend.

Communities across U.S. to honor 9/11 anniversary

Communities across the country will also be honoring those who were  lost in the tragedy. Below is a list of how some areas plan to remember  the fallen. If your city, town, neighborhood, or civic group is  planning to hold a ceremony or a moment of silence to honor the day, share it with us.

New York City: The 9/11 Memorial will officially open on Sept. 11 with a ceremony for victims’ families at Ground Zero. The  Memorial will then open to the public on the next day for visitors who reserved passes in advance. On Sept. 10, Community Board 1 will hold Hands Across Lower Manhattan, an event on the West Side Waterfront.

Washington, D.C.: Those who died in the attack  at the Pentagon will be honored at a ceremony of 700 people, including  family members of the deceased and members of the military. It will  take place at the Pentagon Memorial, which opened in 2008.

Shanksville, Pa.: A commemorative service to honor those who died on Flight 93 will take place at 9:30 a.m. ET on Sept. 11 at the Memorial Plaza.  Musical tributes, wreath layings, and additional activities will  continue throughout the afternoon.

VIDEO: Gary Sinise Says 9/11 Inspired Him to Support America’s Military

Gary Sinise is best known for his role as Lt. Dan Taylor in the 1994 blockbuster movie “Forrest Gump.” It earned him an Oscar nomination for best supporting actor and a starring role on “CSI: NY.” Now the actor is using his fame to celebrate America’s heroes on the battlefield.

This week marked the debut of a documentary about Sinise’s role with the Lt. Dan Band. After the 9/11 terrorist attacks, Sinise formed the band — name after his character from “Forrest Gump” — to perform for servicemen and women. Filmmakers traveled around the world for two years to document the band’s work. Several celebrities, including Academy Award winners Jon Voight and Robert Duvall, appear in the film.

Sinise was in Washington last week and visited Heritage to talk about the military and how 9/11 changed his outlook on life.

“Lt. Dan Band: For The Common Good” is available to view online or DVD. A portion of the proceeds will be donated to The Gary Sinise Foundation to support military, veterans, first responders and their families.

Different states tax their residences at different  levels. 24/7 Wall St. reviewed a report recently released by  the Tax Foundation to identify the states where residents paid the most and  least in state and local taxes as a percent of income.

Top 10 States with the Highest Tax Burdens:

New  York places much of its tax burden on residents from other states. Consider, for  example, the amount of state revenue derived from New York City tourism, or  those who commute to the city for work. Despite this, state residents maintain  the second largest tax burden in the country. The state has one of the highest  state and local tax collections per capita, an average of $6,884. It has one of  the highest combined averages local and state sales tax rates — 8.3%. The Big  Apple also has a number of exceptionally high excise taxes, such as its $4.35  tax on each pack of cigarettes, the highest rate in the country. Additionally,  the state has exceptionally high property tax rates. According to the Census  Bureau, the top ten counties in the U.S. with the highest property taxes as a  percentage of home values are all in New York.

Alaskans have the lowest tax burden of any state in  the country, paying just 6.3% of their income in state and local taxes. This is  over one full percentage point lower than the state with the second smallest tax  burden. According to the Tax Foundation, “Before the Trans-Alaska pipeline was  finished in 1977, taxpayers in Alaska bore the second-highest tax burden in the  country. By 1980, with oil tax revenue pouring in, Alaska repealed its personal  income tax and started sending out checks instead. The tax burden plummeted, and  now Alaskans are the least taxed.” The state also levies no personal income tax  or sales tax.

The population of Texas  is 30% larger than New York, but collects more than 60% less in tax revenue than  the Empire State. The tax burden on residents is the sixth lowest in the  country, at just 7.9% of average income per resident. The biggest reason for  this is that the state is one of just six in the country to levy no personal  income tax. Texas also has the 11th lowest sales tax, at 7.39%, and average or  below average rates on gasoline, cigarettes and alcohol.

Take Action as New York City Mayor bans prayer but not politics for 9-11 Memorial

Ten years ago, in the wake of the worst terrorist attack in our nation’s history, Americans turned to God for solace. Members of the clergy on the scene and across the nation gave aid, comfort, and hope to the shocked, the fearful, and the bereaved. As the tenth anniversary of that day approaches, we would do well to turn our eyes again toward our Protector.

Unfortunately, New York City Mayor Michael Bloomberg would have us look the other way.

At a Ground Zero commemoration for the families of victims, Mayor Bloomberg is allowing the presence of politicians and presidents, but no pastors or prayer. The mayor of course will be there, but politicians weren’t then — and are not now — nearly enough.

Please sign our petition to Mayor Bloomberg asking that he give pastors and prayer a place at this most solemn remembrance of such a pivotal moment in our nation’s history. As we deliver the petition to the mayor’s office, pray with me that he’ll see that this nation needs prayer more than politics.

NYC Mayor Bloomber Bans Clergy from 9-11 Ceremony

So says Fox Nation, based on reporting by the Wall Street Journal.

Religious leaders are calling on Mayor Michael Bloomberg to reverse course and offer clergy a role in the ceremony commemorating the 10th anniversary of the terrorist attack on the World Trade Center.

Rudy Washington, a deputy mayor in former Mayor Rudolph Giuliani’s administration, said he’s outraged. Mr. Washington organized an interfaith ceremony at Yankee Stadium shortly after the Sept. 11, 2001, attacks.

“This is America, and to have a memorial service where there’s no prayer, this appears to be insanity to me,” said Mr. Washington, who has suffered severe medical problems connected to the time he spent at Ground Zero.

Fox Nation pairs that story with this flashback, in which Bloomberg goes to bat for the Ground Zero Mosque on religious freedom grounds.

What if the majority of New Yorkers, or the majority of Americans, want clergy at the 9-11 ceremonies? If asked, I suspect that they do.

The announcement drew particular outrage from Rudy Washington, who served as deputy mayor under former Mayor Rudy Giuliani and organized an interfaith service at Yankee Stadium in the wake of the attacks.

“This is America, and to have a memorial service where there’s no prayer, this appear to be insanity to me,” Washington told the Wall Street Journal. “I feel like America has lost its way.”

New York City Councilman Fernando Cabrera, a pastor at a Bronx church, said he was similarly shocked and disappointed that clergy would be excluded, feeling like it was “wiping out the recognition of the importance that spirituality plays on that day.”

Of course it makes it even more of an outrage when you consider Bloomberg was a vocal supporter of the so-called “Ground Zero mosque“.

9/11 TV 10 Year Anniversary Specials

Tonight begins the first of more than 40 TV specials marking the 10th anniversary of Sept. 11 — the biggest outpouring of work on a single event anyone can remember.

The Steven Spielberg-executive produced “Rising: Rebuilding Ground Zero” — six hours in all — for Discovery (8 p.m.) may be the most-ambitious of the specials. But it will not be the most emotional.

CBS’ updated “9/11: Ten Years Later” (Sept. 11, 8 p.m.) is expected to be a standout, in part because of what it has — footage of the first plane crashing into Tower One of the World Trade Center.

Nearly a decade after “9/11” originally aired, the Emmy-winning documentary, narrated by Robert De Niro, remains “one of the most important historic records of the tragedy and heroism of that day,” CBS producer Susan Zirinsky says.

The story of Engine 7 Ladder 1 in TriBeCa, in the shadow of the Trade Center, was the most-watched 9/11 documentary of its time.

And because of that, Zirinsky and her team wanted to maintain the integrity of the original footage. Still, they did update it by revisiting the 14 firefighters from the original documentary to see what’s happened to them, and to get their take on the events of the intervening decade.

“Our focus is on this one firehouse, but what it becomes is a snapshot of 9/11,” she says.

I’ve written this before, but now’s the time to hear for yourselves.

With the 10th anniversary of the 9/11 attacks approaching, the news media, as well they should, will be all over this story.

But listen. The perpetrators of the slaughter will be treated with perverse respect, and simple, plain truth-telling will be avoided — just in case anyone out there is inclined to claim that the reporters and their networks are anti-Islam.

Listen for how the innocent dead are addressed. We will hear that they “died,” that they “perished,” that they were “lost” and that they were “killed” on 9/11. We will hear that they were victims of a tragedy, a cataclysmic horror.

But one fact will go largely unspoken. We will not hear that they were murdered.

How often have you heard that indisputable truth spoken on newscasts since 9/11? How often have you heard that the 2,977 innocents who died on 9/11 were “victims of a mass murder”?

And it’s unlikely that you’ll hear that much in the 9/11 remembrances, overviews and personal profiles that TV will present, day and night, over the next month.

Although the 9/11 murderers were driven by their radicalized, insane interpretation of their religion, the Western news media applies an inherent sensitivity toward Islamic extremists in their careful refusal to deal with and report the plainest, clearest — and ugliest — of facts.

National security mascot Rudy Giuliani​ is back in the headlines this week for his latest project with private consulting firm Giuliani Partners. America’s mayor is considering taking a spokesman job with the Entergy Corporation, which operates two reactors at the Indian Point nuclear plant in Buchanan, New York, just 35 miles outside New York City. Giuliani Partners has done some P.R. work for Entergy in the past — during safety controversies in early 2003 and again in 2006 — but this is an entirely different situation. Though it generates 25 to 30 percent of the city’s energy and pumps $126 million a year in labor wages into the local economy, the Indian Point plant is now facing extinction.

In late June, Governor Andrew M. Cuomo sent “one of his top advisers” to meet with Entergy officials and inform them that he is planning to close the Indian Point site. The original 40-year operating permits for the reactors are set to expire in 2013 and 2015, respectively. Though Entergy is applying for a permit renewal from the federal Nuclear Regulatory Commission, Cuomo can effectively terminate that application. All he has to do is withhold a certain water permit that is necessary for Entergy to win the renewal. According to the New York Times, Cuomo’s plan — supposedly based on fear of a meltdown or terrorism — is shortsighted. It “would take years and require a long-term energy strategy” to wean New York off Indian Point’s private-sector 2,000 megawatts of energy, which currently light up schools and businesses across New York City and Westchester County.

Mayor Bloomberg​ strongly opposes Indian Point’s closure and predicts profound economic consequences. According to a leaked preliminary draft of a report by New York City’s Department of Environmental Conservation, Indian Point’s closure would result in the city’s energy costs rising up to 10 percent, with 1,100 layoffs at Indian Point and citywide reliability problems beginning within a year of the second reactor’s expiration.

So why is Cuomo so determined to close the site now? After all, he’s always maintained that he’s “not against nuclear power.”

Cuomo, of course, took $100,000 in  campaign contributions in 2010 from his top individual donor Dan Tishman — chairman of the Board of the National Resources Defense Council, which ranks as one of the most active anti-nuclear special interest groups.

He also took $50,000 from the New York law firm Kaplan Fox and Kilsheimer — one of his top ten organizational donors. That firm’s veteran counsel Charles J. Moxley sits on the board of the anti-nuclear Lawyers’ Committee for Nuclear Policy and also wrote an anti-nuclear book.

Leveraged-buyout guru Fred Iseman, meanwhile, got to Cuomo early, handing him  $55,900 on July 7, 2009. Iseman serves on the Advisory Board of Ted Turner and Sam Nunn’s Nuclear Threat Initiative.

And let’s not forget about all of Cuomo’s real estate developer donors, like Stephen Garofalo ($62,800 in individual contributions) of the Millbrook Ventures commercial real estate firm in Dover Plains, New York. Since 2000, his company has been developing a 670-acre five-star destination spa with its own private residential community in Amenia, New York — just a stone’s throw from Indian Point, with all its tourist-deflecting danger.

Now here’s where it gets good.

Cuomo accepted $55,588 in campaign contributions from the law firm Nixon Peabody. As recently as October 12, 2010 (a month before Cuomo’s election) Nixon Peabody represented an energy company called Competitive Power Ventures (CPV). At the time, CPV was  petitioning the State of New York Public Service Commission for allowance to build a 650-megawatt natural gas-powered plant called the CPV Valley Energy Center in Wawayanda, New York — 50 miles from Manhattan and directly competitive with Indian Point.

The previous month, Nixon Peabody lawyer Ruth E. Leistensnider — a partner in the firm’s Albany energy practice and the sole lawyer representing CPV — had been named to the New York Solar Energy Industries Association board of directors just as that board, coincidentally, announced its support for Cuomo’s solar energy platform.

If Giuliani is getting paid to protect Indian Point, then he has no reason to be defensive. He needs to start questioning Cuomo’s motives and looking into the governor’s relationship with Nixon Peabody and CPV. The results could be explosive.

(So is this just an ethics issue with Cuomo’s not so transparent dealings with regards to his campaign donors, or perhaps Agenda 21 (see our previous post) is driving this, or more likely – both!)

ALBANY – The New York Power Authority spent big money on lavish parties, employee gifts and AARP memberships for retirees, a new audit revealed Wednesday.

The audit covering 2009 and 2010 by state Controller Thomas DiNapoli‘s office identified about $340,000 in questionable expenses at the troubled agency.

NYPA spent $160,000 on a total of 21 holiday parties and picnics for employees, retirees and guests, auditors found.

Another $85,000 was spent over two years on gifts for employee service and recognition – on top of $57,000 for award and recognition ceremonies.

NYPA spent $21,000 on complimentary AARP memberships for all its retired employees and another $10,000 on “empathetic” gifts such as flowers sent to employees who lost loved ones. NYPA also footed the $7,000 in entrance fees and other expenses related to having staff participate in a Corporate Challenge race.

The otherwise positive audit questions “if the purpose and/or the amount of such expense represents the best use of public funds particularly during what are difficult fiscal times for New York State.”

DiNapoli recommended NYPA “limit or eliminate spending on nonessential [like] parties, ceremonies, gifts and memberships.”

NYPA officials defended their practices, calling the spending “minor in scope” and designed to boost employee morale.

In a July 22 letter to DiNapoli, agency head Michael Townsend argued the authority has cut costs.

He said the $57,000 for award programs was down 62% from 2007 and has been eliminated.

He said the $80,000 for parties last year was 27% lower than the $109,000 spent in 2007.

NYPA is seen as a patronage dumping ground. Its president and CEO, Richard Kessel, is under investigation for donating NYPA money to non-energy charities.

Days after Joint Chiefs Chairman Admiral Mike Mullen told America’s fighting men and women in the battlespace that he could not assure they would get their pay because of last week’s  debt stalemate, New York’s Democrat congressional delegation had no qualms about risking the pay of the America’s heroes. All of the Democrats in New York’s congressional delegation put the welfare state before the members of America’s armed forces in voting against the debt ceiling compromise.

The compromise raised the debt ceiling in exchange for future spending cuts.  While New York’s Republican delegation was rightly troubled by how little spending would be cut in the compromise, they didn’t dare risk putting  America’s fighting men and women’s pay in jeopardy; they knew that, for the Obama Admiinistration, America’s service people are rarely a priority.

For New York’s Democrats, the priority was loyal adherence to the special interests, coalitions, and non-profit groups that profit most from the nation’s massive welfare state.  Soldiers, sailors, airmen and marines — who often already live paycheck to paycheck — be damned.

“Taxed-out New Yorkers are voting with their feet, with a staggering 1.6 million residents fleeing the state over the last decade, a new report found.

That’s as if the entire populations of Buffalo, Rochester, Yonkers, White Plains and West Babylon combined had packed up and left.

For the second consecutive decade, New York led the nation in the percentage of residents leaving for other states, according to the report by the Empire Center for State Policy.

The population loss is “the ultimate barometer of New York’s attractiveness as a place to work, live and do business,” said the report’s co-author, E.J. McMahon. “It’s the ultimate indication that we’ve been doing things wrong.”

Most analysts blamed New York’s high taxes and skyrocketing cost of living for the mass exodus.”

We don’t need an analyst to tell us that last part. Sometimes, we feel like we’re banging our heads against the wall saying this, but why do we put up with it? Can the citizens of the state, and specifically NYC, finally start elected some solid conservatives that will cut taxes and reduce the size of out bloated government? Sadly, we probably don’t have much hope.  

Case in point as to why we have long since wished for a 2 state solution; Western New York and Eastern New York! From our perspective (western) – NYC? – it is hopeless and you can have it!

The letter from ICE terminating ‘all existing’ S-Comm MOAs (Terminating the MOAs, having been deemed unnecessary, actually keeps the program going)

U.S. Immigration and Customs Enforcement director John Morton sent a letter to governors today terminating all existing memorandums of understanding, or MOAs, with the agency regarding Secure Communities. Several state and local leaders had been attempting to withdraw from the fingerprint-sharing program, including the Democrat Governors of Illinois, Massachusetts and New York.

The decision by ICE is intended to keep the program going, even in states and jurisdictions that have announced plans to drop out. A copy of the letter was obtained from California Gov. Jerry Brown’s office. Here are the first few paragraphs:

The letter goes on to discuss changes the agency has made to the program, among them a memo urging agency officials to use prosecutorial discretion in individual immigrants’ cases, a stated focus on “individuals who meet ICE’s enforcement priorities” and policies aimed at protecting victims of domestic violence and other crimes.

Secure Communities, first rolled out in 2008, allows for the fingerprints of people booked into local jails to be shared with immigration officials. Some state and local officials who have come out against it say it can alienate immigrant communities and get in the way of policing, and there have been complaints about the program casting a wider net than intended, landing people without criminal records in deportation proceedings…

(You may recall we here at Rev2010 debunk opponents reasoning and reported recently on Cuomo’s move to withdraw the state while counties such as Chautauqua were continuing the program at the local level, a move by the county worthy of praise.)

Mom killed child ‘over broken TV’  A Bronx mother accused of beating her 5-year-old son to death admitted she lashed out at the child after he broke her TV while playing with his Wii video game — but said her only intent was to “discipline” the boy, prosecutors said yesterday. Initially Kim Crawford, 21, said she just meant to “pop” little Jamar Johnson on the bottom, prosecutors said yesterday in Bronx Criminal Court, where she was charged with murder in the second degree and manslaughter. But over the course of five police interviews, she allegedly admitted she doled out a lot more than just a routine spanking. “I hit Jamar. Twice in the back, twice in the stomach. Harder than I ever hit him,” she admitted to police. The blows were so forceful that the child became gravely ill, slowly dying of internal injuries, cops said.

In the NY9 race Bob Turner is attacking Democrat David Weprin, for taking money from disgraced lobbyist Richard Lipsky for his City Council and Comptroller campaigns.

“David Weprin knows Richard Lipsky is awaiting federal trial for bribery and he knows he took money from him, so it surprising that Mr. Weprin has not returned the cash,” said Turner campaign spokesman William O’Reilly. “New Yorkers have lost faith in local government because of the avalanche of corruption scandals, especially in Brooklyn. The Lipsky money, regardless of when it was given, is clearly tainted and it should have been returned.” Lipsky has given $1,000 to two of Weprin’s previous campaigns.

Ethics Committee to Probe Fraudster’s Loan to US Rep Meeks (D-NY)

Yesterday 08/05/2011, the House Ethics Committee announced that it has accepted a recommendation by the Office of Congressional Ethics (OCE) to further review allegations against Representative (Gregory) Meeks that he illegally accepted monies.

 

The payment was an unsecured $40,000 “loan” from Edul Ahmad, a Guyanese businessman who was last month arrested in a massive mortgage-fraud scheme. On July 22, the FBI reportedly removed Ahmad in handcuffs from a Guyana-bound aircraft on the tarmac at JFK International Airport.

James Capel, who until February was a top aide to Rep. Charles Rangel (D-NY), pleaded guilty yesterday in Manhattan Criminal Court to charges resulting from his failure to file a tax return for the years 2007, 2008 and 2009. Capel reportedly did not file a tax return from 2003 onward, but was saved from prosecution by the statute of limitations for the earlier years. Capel must pay $42,088 in back taxes and pay a $1,000 fine.

Rangel Junket Figure Karl Rodney Sentenced Today

07/22/2011- Karl Rodney, the organizer of the Caribbean junkets that contributed to the downfall of Rep. Charles Rangel (D-NY), was sentenced today in the U.S. District Court for the District of Columbia to two years probation and 500 hours of community service. He was also fined $2,500. District Judge Emmet Sullivan included no jail time in the sentence.

The courtroom was filled with Rodney’s supporters, many of whom made the trip down from New York City. Singer and known leftist Harry Belafonte offered good wishes by letter. NLPC Chairman Ken Boehm was also in attendance. Boehm said, “I believe that at least some jail time would have been appropriate, but at the same time, Rangel himself has not even been prosecuted and he was guilty of far worse.”

While the media gave the nation images of midnight bliss at Niagara Falls, two homosexuals being “married” in Bloomberg’s office, by the Mayor himself, and various intimate moments elsewhere across the state, mostly in NYC, celebrating the triumph of “equality” while dispensing with 5000 years of marriage as a natural union between a man and a woman, a very different image was already beginning to emerge.

It is an image of blatant violations of citizen rights. An ugly picture of threats and possible miscarriage of the political process in getting to the “vote”. We now learn there were most likely numerous constitutional and legal violations in the journey to “equality.”

Dog and Cock fighting are already felonies, but a new law increases penalties on those who attend the illegal underground events. Until now, a person knowingly attending an animal fighting event was only charged with a violation, punishable by up to a $500 fine.The new law makes it a class B misdemeanor punishable by up to three months in jail and a $500 fine. Repeat offenders face up to a year in jail and a $1,000 fine.

Gov. Cuomo signs bill that cracks down on drivers who are caught texting – In reality it expands state police power whereby you can now be pulled over, detained, and potentially cited, simply because police officer believes they have seen you doing something or other with your cell phone!

Posted by: Jon Campbell @ Gannett,  Jul 21, 2011 – Gov. Andrew Cuomo this week has has been unveiling this week—piece by piece—his plan to create jobs and spark the state’s economy, which he says will be his administration’s major focus for the rest of 2011.

Yesterday, the governor said at least $1 billion will be available for 10 economic regions to compete for a slice of through a competitive grant program. A 52-page summary released by Cuomo yesterday detailed all of the funding available to the regions through a consolidated “mega-application” that each one will complete. That money will come from a variety of state agencies, including $270 million in grants and tax breaks from the Empire State Development Corp. and up to $170 million from the state Energy Research and Development Authority.

Arguments continue over federal lawsuit on hydrofracking in Delaware River Basin; action outside NY may play key role in natural gas exploration; NY Attorney General Schneiderman’s suit is actually pushing for more federal interference and is not representing NYS’s best interests – As a state senator immediately preceeding his role as AG, he continues to be beholden to the left and is seemingly doing whatever he can to appease the enviro lobby demands - Yet the federal government is attempting to have that suit dismissed, arguing that not only that the state doesn’t have the right to sue in this matterm, but also that the Attorney General’s office has not proven its case. Pennsylvania’s top environmental official made that argument in a letter submitted during the commission’s public comment period, saying that oversight by the DRBC in certain areas is duplicative and unnecessary, and therefore more wold certainly be inappropriate and unwarranted.

Chemung County promotes legal action to stop EPA (The EPA is over zealous, over reaching, intrusive, pushing undue burdens and unwarranted costs, and so much so that even the state’s federal reps, including our democrat senators, oppose their demands.)

Chemung County Executive Santulli: “This is probably one of the greatest outrages that I’ve ever had to deal with as long as I’ve been in this office”. Pending pollution rules not needed in N.Y., we already exceed standards and EPA admits more so than the other states involved.

The costs to Chemung County would be more than $30 million, with operating and maintenance costs estimated at $1.8 million annually, and according to Santulli that does not include the costs to the agricultural industry. Santulli said he won’t force Chemung County taxpayers to shoulder this burden. “I wouldn’t come up with this money even if I was directed to do so by the federal government,” he said. “I’m saying I refuse to ask our citizens to give us $30 million for nothing.” The toal cost for the 16 counties in NY to meet the standards is estimated at between $2 billion and $4 billion, he said.

In addition to the Chemung County Legislature, Santulli is asking for support from leaders of Steuben, Schuyler, Tompkins, Broome, Livingston, Allegany, Onondaga, Madison, Oneida, Herkimer, Delaware, Tioga, Cortland, Chenango and Otsego counties, which are all part of the Chesapeake Bay Watershed. In October, Elmira City Council voted to support a resolution that objected to the burden the EPA plan would place on municipalities and farms.

The state Department of Environmental Conservation does not support what the EPA is demanding, Santulli said, but added “To me, the state really rolled over on this one. They took a stand, but for some reason at the end, they didn’t fight the good fight,” he said. “Quite frankly, I think the state ought to be doing what we’re doing.”

Illustrating just how bad the EPA has become, Santulli said he has even received support from U.S. Senators Schumer, D-N.Y., and Gillibrand, D-N.Y., as well as from eight members of the House representing affected counties. However, the EPA has yet to amend the stringent restrictions, he said.

Agenda 21 in New York State – Home Rule and Article X

The recent passage of Article X in New York State illustrates a direct assault on the treasured principle of Home Rule. Connecting the dots and tying the links together forecast a grim reality that is ready to explode into a vicious turf fight.

New York State is a “Home Rule” jurisdiction, dating back to 1923. New York Municipal Home Rule – Article 2 – § 10 General Powers of Local Governments to Adopt and Amend Local Laws, provides the authority for the cherished prerogative of communities to control their destinies. The stark conflict of local self-determination and the arbitrary imposition of bureaucratic fiats outlined in Agenda 21 are self-evident. Under the guise of streamlining energy siting and land use, New York State has jumped to the tune of the globalist marching band orders. In the darkness of midnight in a closed room, the new governor Andrew Cuomo pushed a secret version of Article X, and the legislature voted approval for the Power NY Act.

NYS Senator Patricia Ritchie’s opposition explains the violation on Home Rule. Assembly representative Sean Hanna‘s passionate argument against this attempt to diminish Home Rule, also echoes the sentiment. 

“The topic of drilling in the Marcellus Shale has elicited an overwhelming response with varied opinions on all sides of the issue. One thing that cannot be discounted moving forward is the desire of local residents,” said Senator Seward. “That is why I am co-sponsoring legislation (S.3472) that would empower local governments and allow them to regulate natural gas drilling through local planning and zoning.”

ICLEI – Local Governments for Sustainability (formally, International Council for Local Environmental Initiatives). Communities pay ICLEI dues to provide “local” community plans, software, training, etc. Addition groups include American Planning Council, The Renaissance Planning Group, International City/ County Management Group, aided by US Mayors Conference, National Governors Association, National League of Cities, National Association of County Administrators and many more private organizations and official government agencies. Foundation and government grants drive the process.

The entire substructure of alphabet soup, state and federal agencies, are on notice to facilitate and implement the systematic purging of local independence. Governor Cuomo left out the true meaning of the Power NY Act. “An Investment to Create More Power in New York” is designed to consolidate central planning under the control of Agenda 21 dictates. This bill has little to do with fostering cheap dependable energy, but has everything to do with neutering your local town board. This policy is not about energy. Look into why New York State rejected the low cost guaranteed electricity proposal from Canada.

“New York backed out of a long term contract with Hydro Quebec– a contract that was needed to justify the construction of the “project of the century,” the James Bay II project. As a consequence, Hydro Quebec put its planned James Bay development “sur la glace” (“on ice”) and activists celebrated the victory and moved on to other issues.”

The Wall Street syndicate lusts for their cap and trade mandates so that the next financial bubble can start the next cycle of fleecing the public. Remember that your own local government is viewed as an impediment to the Agenda 21. Soon your town board will be inoperative, iced in the same manner as economical energy from O Canada . . .

NYSERDA seeks to ‘transform our economic system’

Nov 29, 2010 – As the G20 summit meeting scheduled in Cancun approaches, the U.N. Intergovernmental Panel on Climate Change (IPCC) co-chair, Dr. Edenhoffer of Germany, candidly admitted, “… One must say clearly that we redistribute de facto the world’s wealth by climate policy.” This has been clearly exemplified here in the United States by the fact that of the $2.2 Billion dollars of the stimulus money that was allotted for “renewables” (and all the “green” jobs it would supposedly create) — over 80% of that money went overseas (See: http://investigativereportingworkshop.org/investigations/wind-energy-funds-going-overseas/story/renewable-energy-money-still-going-abroad/ ). Industrial wind is a major component of the IPCC’s “climate policy” redistribution of wealth scheme, and NYS – with plenty of Big Wind lobbyists and political cronies in high places, is a major player in this redistribution of wealth and, as Al Gore & George Soros refer to it – “global governance” scheme.

The push for the redistribution of our wealth through politicalization of our energy policies was made clear once again at the annual NYS Energy Research & Development Authority (NYSERDA) “Partnership for Environmental Improvement” meeting held on 11/18/10 in Albany, when NYSERDA executive, Janet Joseph stated, “…We are looking at transforming our economic system.”

An Ill First Wind Hits the Public in the Pocketbook - The promises of alternative energy generated from industrial wind turbines are suspect when examined on the facts. The basis for justification for the entire industry is that electricity generated from uneconomical technology is environmentally friendly. The public is supposed to accept higher costs from inefficient and unreliable generation just because it is “green”. Touting wind as a free source of energy is dishonest. This old technology from skyscraper size industrial machines is anything but free. The media seldom reports that industrial wind does not produce cost effective reliable electricity. Cowardly politicians who dare not oppose the industry ignore indisputable and inescapable facts about wind.

Rational reasons against spending public expenditures for subsidizing a technology that has never yet replaced a fossil fuel power plant is overwhelming. If industrial wind factories were a real solution, why will not entrepreneurs develop their projects the old fashion way, with their own money?

Government policy that favors and protects the economic failure of wind projects is essential for the deception to continue. Even proponents of the most radical global warming myths are taxpayers and consume electricity. Where is their outrage when costs increase at exponential rates, from ill-conceived wind projects, with no ceiling in sight? For answers, an examination of the First Wind Company provides a window on a culture of corruption that is indefensible. (SEC, FERC, Loans, Defaults, Leaseholders, Federal Simulus funds, and other subsidies, collusion, conflicts of interest, improper dealings-gov officials, ethical breaches, shell companies ect…)

Even former U.S. Rep. Eric J. Massa (D-N.Y.) took issue with his own administration, writing to President Barack Obama, calling the grants “very alarming” and saying the company “abused the public trust” and had problems with U.S. tax dollars going to what he called “shell companies” for First Wind. Massa noted, “First Wind is under investigation by the New York Attorney General’s office for alleged corruption. The actual appropriation is going to Canandaigua Power Partners and Canandaigua Power Partners II, subsidiaries of First Wind.” “This is one of the most volatile issues in Western New York, and the award of $74.6 million dollars to corrupt companies that have changed names time and again, forming new LLCs and new Inc’s but maintaining their business model of lie, cheat, and corrupt at the expense of taxpayers, has stirred great unrest in New York’s 29th Congressional District,” Massa wrote to the president.

First Wind CEO Paul Gaynor, a former Enron executive, responded in a letter to Obama, saying that First Wind’s New York wind farms have produced 133,370-megawatt hours of clean, renewable energy, but never provided any proof of his claim. How does a company like First Wind gain favorable benefits and access to energy policy?

Reporter Naomi Schalit of the Maine Center for Public Interest provided some insights in the article, Ex-PUC head enriched by utility company. “While he was Maine’s chief utilities regulator, Kurt Adams accepted an ownership interest in a leading wind energy company . . . A recent First Wind filing with the federal SEC for 2009 shows Adams’ $1.3 million compensation included $315,000 in salary, $658,000 in stock awards, $29,000 of “other” compensation and $315,000 in “nonequity incentives.” The latest First Wind SEC filing attempts to downplay the conflict of interests and breach of ethical conduct of Mr. Adams. Their explanation does not pass the smell test. Such suspect business practices are standard behavior for First Wind. It has a long history of using political insiders to gain special treatment.

Documented in the Citizen Power Alliance essay, Industrial Wind and the Wall Street Cap and Trade Fraud is the dark origins of First Wind, previously called UPC. The Boston Herald asked Brian Caffyn, founder of UPC/First Wind, about the arrest for fraud of his former Italian wind developer partner Oreste Vigorito. “I read about it in the papers, and I was very surprised,” Brian Caffyn said from Hong Kong where he is in business with Chinese interests.

The political cronyism between First Wind and the Obama administration extends to Rahm Emanuel and Larry Summers and their involvement with the primary ownership interests of First Wind, hedge fund DE Shaw and private equity firm Madison Dearborn. Documented sources within the CPA article substantiate the trail of money and influence that flows from this wind developer to the highest levels of government.

New York State a den of thieves (Flashback: Patterson was Gov, now Gov Cuomo was Atty Gen, now AG Schneiderman was a State Senator)

NYS operates as if it is a suburb of Chicago. IDA (industrial development agencies) sell tax exemptions, state agencies ignore their own policy regulations to advance wind development, the attorney general office looks the other way when conflict of interest practices lead to criminal conduct and local public officials routinely take bribes for their vote and support of specific projects.

With each complaint to the Public Service Commission, the PSC bends over backward to have First Wind cover their paper trail discrepancies or modify their filings. Governor Paterson’s State Energy Plan calls for a ” ’45 by 15′ clean energy goal would reduce the amount of electricity used in 2015 by 15 percent below forecasted levels, while simultaneously meeting 30 percent of the State’s remaining electricity needs through renewable resources.”

First Wind is in business to claim their share of the booty. REC credits (renewal energy certificates) are the new coin of the realm. It makes little difference if actual electricity is generated into the grid for sale to reap the financial rewards of this slight of hand deception.

Carved in stone is a history of NYS favoring NYC over upstate. The latest insult is the Power for Jobs hoax. The Buffalo News describes this initiative, “The agreement between Paterson and the Senate leaders would set aside slightly less than a third of the electricity — at least 300 megawatts of the 910 megawatts available through the expanded Power for Jobs program — for upstate businesses served by National Grid, New York State Electric & Gas Corp. and Rochester Gas & Electric.” The allocation difference goes to NYC. Assembly representative Joseph Morelle, opposition states, “it takes low-cost hydropower from Rochester and Upstate New York and ships it downstate . . . This proposed shift would result in an increase of approximately $80 to $125 per year on the bill of the average RG&E residential customer.”

What does Western NY get out of this shady deal? You guessed it, more industrial wind turbine disasters from developers like First Wind so they can erect their unsuccessful projects using out of state labor or even undocumented foreign workers. The fallout from the Cohocton Project is a horror story in its own right. Real estate values plummet; sales of properties are non-existent, “Wind Syndrome” health issues abound, an OSHA investigation of a construction crane collapse and final abandonment of residences because of low frequency noise, shadow flicker and safety risks prevent continued use of one home.

The tragic destruction of pastoral communities from insane government policy would fill volumes of books. Most people will never show concern for rural areas or even the corrupt business practices of crooked wind developers. First Wind is just the best example of the unholy alliance and revolving door of crony capitalism that is driving up the costs of electricity beneath the lies of “Greening America” and job promotion. The public is asleep. Their righteous outrage is long overdue. It is time to clean up the system from the dishonesty of industrial wind developers and their connected politicians!
